Purpose of this privacy notice
This privacy notice aims to provide information on how EIML collects and processes your personal data, which we receive either directly from you (as an individual, parent, or carer) or from a family member who subscribes to our services.
We permit children (defined as individuals under the age of 16) to use our services. However, registration must be completed with the consent of a parent or carer, and it must be managed by the parent or carer on behalf of the child.
It is important that you read this privacy notice together with any other privacy notice or fair processing notice we may provide on specific occasions when we are processing personal data about you so that you are fully aware of how and why we are using your data. This privacy notice supplements the other notices and is not intended to override them.
This privacy notice is required to describe what data we may have access to. We do not collect any personal details of the child. Any data provided is solely submitted by the parent or carer when they set up an account.

We only use your data if we can and are allowed to by laws. We have set out the most common reasons we need to use your data below:
- Where we need to perform the contract we are about to enter into or have entered into with you.
- If we have agreed for you to access our services, then we need to know who you are. We only collect what we need, and will never ask for more than necessary.
- Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

Our website is hosted in Australia and data is retained on our site by our host WP Engine.
We do not anticipate transferring your personal data outside of Australia, but data (including personal data) may be transferred outside of Australia to the European Economic Area (EEA) as part of the hosting process for our website.
We are committed to protecting your personal data from being accidentally lost, destroyed, used, accessed in an unauthorized way, altered, or disclosed.
In particular:
- Personal data stored will only pertain to the parent or carer who has signed up, as we do not collect any data related to children, including their names or details.
- We have implemented appropriate security measures to safeguard your personal data. Explore Imagineland uses SSL encryption to securely transfer information between your device and our servers. Additionally, all data is encrypted 'at rest', meaning any data stored on our systems is encrypted.
- Access to your personal data is restricted to those employees, agents, contractors, and other third parties who have a business need to know. These parties will only process your personal data based on our instructions and are bound by a duty of confidentiality.
We also have procedures in place to handle any suspected personal data breaches and will notify you, along with any applicable regulatory authorities, of any breaches where legally required.
Please note that, although we work hard to protect your data, no internet transmission is entirely secure. We cannot guarantee the security of your data while it is being transmitted to our site. Any transmission is at your own risk. Once we receive your information, we will use the security measures mentioned above to prevent unauthorized access.
DATA SECURITY
We work hard to keep your personal data safe and protected from being lost, misused, or accessed without permission.
In particular

DATA RETENTION
How long will you use my personal data for?
We retain the personal data we collect for as long as it is necessary to provide access to the website and manage your account. Since we do not collect data related to children, the information retained pertains only to the parent or carer who has signed up.
To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.
In some circumstances you can ask us to delete your data. Furthermore, we shall be required to delete your data following the instructions of a subscribing school to do so.
In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
We only hold on to data for as long as we really think we need to. For example, so we can keep track of your account and so you can continue to use the services, we will keep hold of your data for as long as you have an active account.
YOUR LEGAL RIGHTS
Under certain circumstances, you have rights under data protection laws in relation to your personal data. We have summarised below key legal rights that you have. It is your data, so it is important you understand what control you have over it. We think these are quite straightforward to understand, but please contact us if you have any questions or anything is not clear.

- Request arasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
- Furthermore, we shall be required to delete your data following the instructions of a subscribing school to do so.

You also have the right to object where we are processing your personal data for direct marketing purposes. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

LAWFUL RASIS
- Lagitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).
